1. Who we are and these terms
First Case Partners is a trading name of C&T Performance Ltd, a company registered in England and Wales under company number 12473423, with its registered office at 155–157 High Street, Aldershot, GU11 1TT, United Kingdom.
In these terms, “we”, “us” and “our” mean C&T Performance Ltd, trading as First Case Partners. “You” and “your” mean the law firm that places an order with us.
These terms apply to every order you place with us. By placing an order or paying an invoice, you agree to them. If an order form or invoice we issue sets out different terms for that order, the order form or invoice applies to that extent.
Our services are for licensed law firms only. They are not for consumers.
2. What we do, and what we don't do
We run advertising and marketing that invites people who have been in a US motor vehicle accident to ask for a call from a law firm. When someone does, we pass their details to one firm as a lead.
Please be clear about what we are not:
- We are not a law firm and we do not employ lawyers to act for consumers.
- We are not a lawyer referral service.
- We do not give legal advice to anyone, and we do not assess or analyse anyone’s legal claim.
- We do not recommend or endorse any lawyer or law firm, and we do not say or imply to consumers that we do.
- We do not handle client money or any funds belonging to your clients.
What you pay us is a fee for advertising and marketing services. It is not payment for a referral or a recommendation.
We do not interfere with your professional judgment, your relationship with any client, or the fees you charge. You decide whether to take on any matter.
You are free to buy leads or marketing from anyone else. We never require you to use us exclusively.
3. Where we operate
We only sell leads for consumers in US states where we currently operate. We do not take orders for, or deliver leads in, any other state.
We confirm on each order form which states we can serve.
We may add or withdraw states at any time, for example where the law changes. If we withdraw a state you buy in, we will tell you as soon as we can. For any prepaid leads in that state not yet delivered, you can choose to move them to another state we serve or have the payment for them returned.
4. What a lead is
A lead is the contact details and answers of a consumer who has asked to be contacted by your firm about a motor vehicle accident. Each lead meets the following criteria, as reported by the consumer:
- the accident happened within the last 30 days, and the accident date is recorded;
- the consumer says they were not at fault, or were at most partly at fault;
- the consumer says they were injured and are receiving treatment (from a doctor, an emergency room or a chiropractor);
- the consumer says they do not yet have an attorney;
- the consumer says a police report was filed; and
- the consumer is located in your state.
All of this information comes from the consumer. We do not verify it, and it is not a statement of fact by us. You must make your own enquiries before acting for anyone.
We never obtain police or crash reports, or any data from motor vehicle records. Every lead comes only from what the consumer tells us.
5. Orders and prepayment
You order leads by completing our order form. Each order states the number of leads, your state and the price per lead.
All orders are paid in advance. We start delivering leads once we have received payment in full.
A small first order is available so you can try the service. We do not offer free samples or free leads.
We may decline any order, for example if we cannot serve your state or cannot fill the order. If we decline an order you have already paid for, we will return the payment.
6. Fees and payment
You pay a fixed price for each lead we deliver. The price is the one shown on your order form or invoice.
The price is fixed before delivery. It never depends on whether the consumer hires you, on the outcome of any matter, or on any legal fee you earn. It is never a share of your legal fees.
Prices are in US dollars (USD) and exclude any taxes, which are added where they apply. You pay by the method shown on the invoice.
7. Lead delivery
We deliver leads by email, by text message (SMS) or directly into your CRM, as agreed when you order.
Leads are delivered as they come in. We do not promise a particular number of leads in a particular period unless your order form says so.
For each lead we keep a record of the consumer’s consent, for example a TrustedForm or Jornaya certificate. You can ask us for the consent record for any lead you have bought.
You must make sure the email address, phone number or CRM details you give us are correct and secure. Once a lead is delivered, you are responsible for keeping it safe.
8. Exclusivity
Every lead is exclusive. We sell each lead to one firm only.
We never resell a lead, and we never pass it to another firm, before or after we deliver it to you.
The consumer’s consent names your firm only, so the lead cannot be shared or transferred.
9. Replacement policy
We give replacements, not refunds. We will replace a lead free of charge only if it has one of these clear defects:
- the phone number is invalid or disconnected;
- it duplicates a lead we have already delivered to you;
- the consumer is outside your state; or
- the consumer tells you they already had an attorney when they submitted their details.
We will never replace a lead because the consumer did not sign with you, did not answer, changed their mind, or because the case was weak or not viable, or for any other reason linked to the result.
To ask for a replacement, email us within 3 days of delivery, naming the lead and the defect and including any evidence. We will check the request and, if it qualifies, deliver a replacement lead that meets the same criteria in the same state.
Replacements are limited to 15% of the leads in each order.
We do not give cash refunds, except as set out in sections 3 and 5 or where the law requires us to. Nothing in these terms limits any right you have by law.
10. Your professional responsibilities
You alone are responsible for complying with the professional conduct rules that apply to you and your firm. This includes:
- the attorney advertising and solicitation rules in your state;
- any rules on paying for leads or marketing, including telling clients about our paid relationship where your rules require it;
- client intake, engagement terms and the fees you charge;
- conflict checks; and
- all legal advice you give.
You must make sure you are licensed to practise in the state of each lead you buy.
11. Contacting consumers (TCPA and telemarketing)
When you call, text or email a consumer from a lead, you must follow all laws on telemarketing and consumer contact, including the US Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, do-not-call rules and state telemarketing laws. In particular, you must:
- contact the consumer only in the way, and for the purpose, covered by the consent they gave;
- call or text only between 8am and 9pm in the consumer’s local time, or within any narrower hours that state law sets;
- honour every opt-out or revocation of consent promptly, by any reasonable means the consumer uses (for example replying STOP to a text or telling a caller), and in any case within the time the law requires, including under the FCC’s revocation-of-consent rules that take effect on 25 November 2026;
- check and comply with the National Do Not Call Registry, state do-not-call lists and your own internal do-not-call list; and
- identify your firm clearly on every call and text, and not block or disguise your caller ID.
Consent records (such as TrustedForm or Jornaya certificates) are available from us on request. Please ask before you need them, not after a complaint.
We do not call or text consumers on your behalf.
12. Data protection and confidentiality
Leads contain personal information, including information about a person’s injuries and treatment. You must treat it as confidential. You must:
- use each lead only to contact that consumer about their own accident claim;
- never sell, share, rent or disclose a lead to anyone else, except your own staff and service providers who need it to do that;
- keep leads secure, with appropriate technical and organisational safeguards;
- delete or return lead data when you no longer need it, unless the law requires you to keep it; and
- tell us without delay if you suffer a security breach that affects any lead.
Our Privacy Policy explains how we handle personal information.
We keep your firm’s details and the terms of our dealings with you confidential, unless the law requires us to disclose them.
13. No guarantee of results
We do not promise that any lead will answer, become your client, or lead to a case, a settlement or any fee.
Apart from the replacement policy in section 9, we give no other promises about leads, except those the law does not allow us to exclude.
14. Limitation of liability
Our total liability to you for all claims connected with these terms or our services is limited to the fees you paid us for the order the claim relates to.
We are not liable for any loss of profit, revenue, business, clients or fees, or for any indirect or consequential loss.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit or exclude.
15. Indemnity
You will compensate us for any claims, fines, losses and reasonable costs (including legal fees) we suffer because of:
- how you or anyone acting for you contacts a consumer, including any breach of the TCPA, do-not-call or telemarketing laws;
- your breach of the professional conduct or advertising rules that apply to you;
- your misuse of lead data, or any breach of section 12; or
- any other breach of these terms by you.
16. Term and termination
These terms apply from your first order until all your orders are complete, or until they are ended under this section.
Either of us can stop future orders at any time by telling the other in writing. Any prepaid leads not yet delivered will still be delivered.
We can suspend deliveries or end these terms straight away if you seriously breach them, for example by misusing leads, breaching telemarketing laws or failing to pay.
Sections 9 to 15, 18 and 19 continue to apply after these terms end, as does any obligation to pay for leads already delivered.
17. Changes to these terms
We may update these terms from time to time, for example to reflect changes in the law. The date at the top of this page shows when they last changed.
Changes apply to orders placed after the new terms are published. They do not change an order you have already paid for.
18. Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them, are governed by the law of England and Wales.
The courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim.
19. General
These terms, together with your order form or invoice, are the whole agreement between us about our services.
If any part of these terms is found to be invalid, the rest still applies. If we do not enforce a term straight away, we can still enforce it later.
You may not transfer your rights under these terms to anyone else without our written agreement.
Notices under these terms must be in writing. Email counts as writing. Send notices to us at [email protected], and we will send notices to the email address on your order.
