1. Who we are
First Case Partners is a trading name of C&T Performance Ltd, a company registered in England and Wales under company number 12473423, with its registered office at 155–157 High Street, Aldershot, GU11 1TT, United Kingdom.
In this policy, “we”, “us” and “our” mean C&T Performance Ltd, trading as First Case Partners. We are the controller of the personal information described in this policy, which means we decide how and why it is used.
We are a marketing company. We are not a law firm, we do not give legal advice, and contacting us or completing our forms does not create an attorney-client relationship with anyone.
2. Who this policy covers
This policy explains how we handle personal information about two groups of people:
- People who ask to be contacted about a car accident (“consumers”). These are people in the United States who respond to our advertising and complete one of our forms.
- People at law firms who visit this website, fill in our order or contact forms, book a call, or buy leads from us (“business contacts”).
Our services are for adults. We do not knowingly collect information from anyone under 18, and we delete it if we find we have.
3. Information we collect
From consumers
When you complete one of our forms, you give us:
- your name, phone number, email address and location (such as your state, city or ZIP code);
- details about your accident, such as the date, what happened, who was at fault and whether a police report was filed;
- whether you were injured, and what treatment you are receiving (for example from a doctor, an emergency room or a chiropractor);
- whether you already have an attorney; and
- your answers to any other questions on the form.
Information about your injuries and treatment is health information. We treat it as sensitive, and we only collect and share it with your consent.
We also keep a record of your consent. This includes the date and time you submitted the form, the exact wording you agreed to and your IP address. Where we use a consent-verification service, it also includes that service’s record of your visit to the form page.
We never obtain police or crash reports, or any information from motor vehicle records. Everything we hold about your accident comes from what you tell us.
From business contacts
When you use our website or work with us, we collect:
- your name, role, work email, phone number, law firm name and website;
- your answers on our order form, such as the states you want leads in, your current lead spend, your budget and your preferred starting volume;
- anything you write in a message to us, and records of calls and meetings you book with us; and
- order, invoice and payment details. Card payments are handled by our payment provider, and we do not store full card numbers.
We may also find business contact details, such as a work email address, from public sources like law firm websites and professional directories.
From everyone who visits our websites
Like most websites, ours automatically collect some technical information, such as your IP address, browser and device type, the pages you visit and how you arrived. See section 12 for more about cookies and similar technologies.
4. How we use information, and why
Data protection law in the UK requires us to have a legal reason for each use of personal information. Here is what we do and the reason we rely on.
Consumers
- To pass your details to one law firm so that it can contact you about your accident. We rely on your consent, including your explicit consent for your health information.
- To check that your request meets our criteria before we pass it on. We rely on your consent.
- To keep a record of your consent, and to deal with any complaint or legal claim. We rely on our legitimate interest in being able to show that we acted properly, and on our legal obligations.
- To honour a request to stop contact, for example by keeping your number on a do-not-contact list. We rely on our legal obligations.
We do not call or text consumers to market anything to them. We do not use consumers’ answers about their accident, injuries or treatment for advertising, and we do not send those answers to advertising platforms.
Business contacts
- To respond to your enquiry, arrange calls and set up orders. We rely on taking steps at your request before entering into a contract, and on performing our contract with your firm.
- To deliver leads, send invoices and handle replacements. We rely on performing our contract.
- To keep business and tax records. We rely on our legal obligations.
- To tell you about our services by email or LinkedIn. We rely on our legitimate interest in growing our business. Every marketing email lets you opt out, and you can opt out at any time by emailing us.
- To run, secure and improve our websites and measure our advertising. We rely on our legitimate interests, and on your consent where the law requires it for cookies.
5. Consent and how you will be contacted
Before you submit one of our forms, we ask you to agree to be contacted about your accident by a law firm, including by phone call and text message, which may use automated technology. The form tells you that your details will go to one law firm only, and names that firm where it is known at that point. We never share your details with more than one firm.
Giving consent is not a condition of buying anything or of using any service. Message and data rates may apply to texts.
You can withdraw your consent at any time, by any reasonable means. For example, you can reply STOP to a text, tell the caller you do not want to be contacted, or email us at [email protected]. If you contact us, we will stop sharing your details and tell the law firm that received them that you have withdrawn your consent.
The law firm that receives your details becomes responsible for how it contacts you and how it uses your information. Its own privacy policy will apply to you once it has your details.
6. Who we share information with
Consumers’ information is shared with:
- One law firm. We sell each request to one law firm only, for a fee. The fee is paid per request and never depends on whether the firm takes your case or on its outcome. We never pass the same request to another firm, before or after.
- Our service providers, who process information for us under contract and only on our instructions. These include our customer relationship and website platform (HighLevel), consent-verification and phone-verification services, email and messaging providers, and cloud hosting.
Business contacts’ information is shared with:
- our service providers, including our website, CRM and calendar platform (HighLevel), email and outreach tools, payment providers and our accountants.
Everyone
We may also share information where the law requires it, to protect our rights or to deal with a legal claim, with our professional advisers, or with a buyer if we sell all or part of our business.
We do not sell business contacts’ information to anyone.
7. Notice for US residents
Some US state privacy laws give residents extra rights. Depending on where you live and whether a law applies to us, these may include the rights to:
- know what personal information we hold about you and how we use and share it;
- get a copy of it;
- correct it;
- delete it;
- opt out of the “sale” of your personal information or its use for targeted advertising; and
- limit how we use sensitive information, such as health information.
Passing a consumer’s request to a law firm for a fee may count as a “sale” under some of these laws. We only do this with the consumer’s consent. If you do not want us to sell your information, email [email protected] with “Do not sell” in the subject line and we will not share it again. We also treat a browser’s Global Privacy Control signal as a request to opt out where the law requires it.
The categories of consumer information we collect, and may share with one law firm, are: identifiers (name, phone, email); location; accident details; and health information about injuries and treatment. Our source is the consumer, through our forms.
We will not treat you differently for using any of these rights. You can use an authorised agent to make a request for you, and we may need to check your identity and the agent’s authority first. If we turn down your request, you can ask us to look at it again by replying to our answer.
8. Transfers outside the UK
We are based in the UK, and many of the people whose information we handle are in the US. Our service providers, and the law firms that receive leads, are mainly in the US.
When we transfer personal information from the UK to another country, we make sure it is protected. We do this by using providers certified under the UK Extension to the EU-US Data Privacy Framework, or by using the UK International Data Transfer Agreement or Addendum, or another safeguard the law allows. You can ask us for details.
9. How long we keep information
- Consumer requests and consent records: 5 years from the date of the request, so that we can show the consumer agreed to be contacted if a question or claim ever arises.
- Do-not-contact requests: for as long as needed to keep honouring them.
- Business contacts and order records: for as long as we work with your firm, then 6 years, to meet our tax and legal obligations.
- Enquiries and outreach contacts that do not lead to an order: 2 years from our last contact with you.
When we no longer need information, we delete it or make it anonymous.
10. Your rights
Under UK data protection law, you have the right to:
- ask for a copy of the personal information we hold about you;
- ask us to correct information that is wrong or incomplete;
- ask us to delete your information;
- ask us to restrict how we use it, or object to our use of it, including for marketing;
- ask us to transfer information you gave us to another organisation; and
- withdraw your consent at any time, where we rely on consent. This does not affect anything we did before you withdrew it.
Some of these rights have limits. For example, we may need to keep a record of your consent and of your request to stop contact. We will explain if a limit applies.
If you are a US resident, see section 7 for the rights you may have under US state laws.
11. How to make a request or complaint
To use any of your rights, email [email protected]. Please tell us your name and the phone number or email you used, so we can find your information. We will reply within one month, or sooner where the law requires it.
If you are unhappy with how we have handled your information, please tell us first so we can try to put it right. You also have the right to complain to the UK Information Commissioner’s Office (ICO) at ico.org.uk, or to the data protection or consumer protection authority where you live.
12. Cookies and similar technologies
Our websites use cookies and similar technologies. Some are needed for the site to work, such as remembering your progress through a form. Others help us understand how the site is used and measure our advertising, for example tools provided by Google and Meta (Facebook). These tools may learn that you visited or completed one of our forms, but we do not send them your answers about your accident, injuries or treatment.
Where the law requires it, we ask for your consent before using non-essential cookies. You can also block or delete cookies in your browser settings. If you block essential cookies, parts of the site may not work.
This website loads its fonts from Google Fonts, which means your browser connects to Google’s servers and shares your IP address with Google.
13. Security
We use appropriate technical and organisational measures to protect personal information, including access controls, encrypted connections and reputable service providers. Only people who need information to do their job can see it.
No system is completely secure. If a security breach affects your information and the law requires us to tell you, we will.
14. Changes to this policy
We may update this policy from time to time. The date at the top shows when it last changed. If we make a significant change, we will make it clear on this page.
